I. Privacy Policy

We respect your privacy. Any and all information collected on this site will be kept strictly confidential and will not be sold, disclosed to third parties or reused without your permission. Any information you give to us will be held with care and will not be used in ways that you have not consented to.

i. What Personal Data do we process and for which purposes

In general, you can visit many of our web pages without telling us who you are or revealing any personal information about yourself. We may track the Internet domain address from which people visit us and analyze this data for trends and statistics, but individual users will remain anonymous, unless you voluntarily tell us who you are. However, some services may require you to provide us with personal data, which may include your direct identifiers.   Such information is asked for when you purchase or order a product, subscribe to a service, register to receive catalogs, or to participate in contests, sweepstakes or promotions, etc.  The information, we ask you to provide is certain information about yourself, such as your name, shipping/billing address, telephone number, email address, credit card information, birth date, gender, occupation, personal interests, etc. We also maintain a record of your online product purchases, and at times, we may think a product or service may be of interest to you, or we may want to communicate with you for other purposes which are evident from the circumstances or about which we inform you when we collect Personal Data from you.    Whether or not to provide such information is completely your own choice. But if you choose not to provide the information we request, you may be unable to purchase products, or access certain services, offers and content on our web site.  We do not use your information to make automated decisions, and allow you to unsubscribe from newsletters.

ii.  Use of Cookies:

A cookie is a small text file that is sent by a website to your computer or mobile device where it is stored by your web browser. A cookie contains limited non-personal data, usually a unique identifier and the name of the site. This enables a website to recognize movement around the site and/or each time you revisit.  Most of the cookies are generated for use as Google analytics tools, which just lets us know how many sessions where in a given time or day, and how long each session lasted, but no personal data is shared. If you have Google set to remember passwords, or form information, that setting can be changed on Google, as it is not managed by Sweet Dreams/Dian Austin, and Sweet Dreams/Dian Austin does not receive any personal detail from those transactions.  Additionally, cookies, allow the site to work more efficiently for you when you revisit, but again, only as anonymous unless you choose to tell us who you are. Sweet Dreams/Dian Austin also will use cookies to pinpoint your location when you use our find a store page. To remove cookies, simply, clear your browsing history.

II. How data is Secured and Third-Party access.

All data, that is personal, that you choose to share, is collected on a secure server and accessed by company members with authorized ids.    European Countries, are not serviced by our ecommerce platform and we do not transfer personal data information to our international partners collected from this site.

At times, Sweet Dreams/Dian Austin may work with a 3rd party vendor specializing in ecommerce, SEO or data marketing, as well as web development.  These parties sign non-disclosures and work as directed, under the supervision of an authorized company member.

IV. Disputes

Any dispute or claim relating in any way to these to the Terms and Conditions, this Website, or any products or services sold or distributed by or through this Website, will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to the Terms and Conditions. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
